Article 1 – Services
The services offered by Céline Picard are recreational workshop animation services.
Article 2 – Quotation
“Anniversary” or on-demand services (for individuals or professionals) are subject to a free quote (PDF) valid for 1 month from the date of issue. The general conditions of sale are systematically appended to the estimate.
Any signed estimate is valid for acceptance of these general conditions of sale, the prices appearing therein, the method of payment as well as the deadlines agreed between the customer and the service provider Céline Picard.
Acceptance of the quote commits the customer to pay for the service within the time limits (see article 6). In the event of modification of the T&Cs or prices, the customer continues to refer to those he received upon receipt of his quote.
Article 3 – Delivery
For organizational purposes for the client and for the service provider Céline Picard, the dates of the workshops will be anticipated and planned.
In the event of cancellation of a workshop by the service provider due to force majeure, the latter must propose a later date, within 48 hours of the date initially scheduled.
The customer is asked to cancel his reservation in the event of withdrawal.
For workshops subject to quote: in the event of cancellation by the customer, the 30% deposit will not be refundable insofar as they represent the investment in equipment, supplies and time necessary for the preparation of the workshops._cc781905 -5cde-3194-bb3b-136bad5cf58d_
Article 4 – Rates
As VAT is not applicable (article 293 B of the CGI), the prices indicated are exclusive of tax. The total amount of the invoice is therefore net of VAT. The prices mentioned on the site http://atelier-enfant-rouen.fr/ are given as an indication. An adapted estimate will be made on the basis of these and according to the expectations of the customer.
The evolution of certain prices cannot impact a current contract: the mission carried out is invoiced according to the mentions made in the estimate when it is signed.
Article 5 – Methods of payment
Any payment may be made by cash or check within a maximum of one week upon receipt of the service. For cash payments, the customer is asked to top up.
For workshops requiring an estimate: payment of a deposit of 30% of the total amount of the estimate will be requested. The remaining 70% will be paid upon delivery.
Late payment penalties will be pronounced if payment deadlines are not respected (see article 7).
Article 6 – Late penalties
Late payment penalties are payable without any prior formal notice being necessary, when payment is made after the date mentioned on the invoice. They run for each day of delay. The late payment penalty rate is three times the legal interest rate on the total amount of the invoice, whether part of the service has already been paid or not.
Late penalties are calculated as follows:
(invoice amount x applicable rate) x (number of days late/365)
A lump sum compensation of €40 for recovery costs (article L.441-6) is added to the late payment penalties. If the recovery costs actually incurred are greater than this lump sum, additional compensation may be requested upon justification. The compensation is due in full, even in the event of partial payment of the invoice on the due date, regardless of the duration of the delay.
Late payment penalties are due for each unpaid invoice and not for a set of invoices. The same applies to the fixed compensation of €40.
The fact of requiring the service provider to delay issuing the invoice in order to extend the payment period is considered an abuse and is sanctioned.
Articles L.441-6, L441-5 and L.441-10 of the Commercial Code.
Article 7 – Withdrawal and breach of contract
The withdrawal period is 14 days from the day after the customer has signed the quote.
